It has become more difficult, but a well-prepared case with the correct legal argument CAN still be granted.
The Immigration Service announced last week that anyone who files for asylum as of this date, and moving forward, with have an interview scheduled within 21 days.
All persons who have already filed for asylum will be considered “non-priority” and will continue to have to wait for an interview until the new cases that are being filed have been adjudicated.
INS announced 1/13/2018 that it will begin accepting DACA applications for RENEWAL ONLY due to the injunction issued by the Ninth Circuit ordering a nationwide ruling that prevents DACA from ending. It is NOT for first time applications.
